Terms of Service

1. Agreement and eligibility

These Terms of Service govern your access to and use of HardCarrx. By using the service, you represent that you have authority to bind yourself or the entity you represent and that you are legally permitted to use the service.

2. The service

HardCarrx provides software and infrastructure for AI request routing, caching, memory, observability, dashboard tooling, and related features. We may add, remove, modify, suspend, or limit features at any time.

3. Accounts, keys, and security

You are responsible for account credentials, API keys, provider keys, workspace access, internal authorization, and prompt reporting of suspected compromise. We may suspend or rotate access where reasonably necessary to protect the service or other users.

4. Acceptable use

You may not misuse the service, interfere with infrastructure, exceed or bypass limits, probe or reverse engineer restricted systems, use the service for unlawful, abusive, infringing, or harmful activity, or violate third-party provider terms that apply to your usage.

5. Customer content

You are responsible for the legality, accuracy, quality, and rights clearance of prompts, files, memory records, outputs, and other content you submit through HardCarrx. You must not submit content unless you have the rights and permissions needed to do so.

6. Third-party services and model providers

HardCarrx may route requests to third-party providers at your direction or according to your configuration. Their pricing, availability, output quality, policies, and behavior are outside our control. Your use may also be subject to those providers’ terms and policies.

7. Fees, billing, suspension, and termination

Paid plans, usage limits, quotas, and billing terms may apply. We reserve the right to charge fees, change pricing, suspend access for non-payment, enforce usage caps, refuse high-risk usage, or terminate accounts for abuse, legal risk, operational risk, or material breach of these terms.

8. Intellectual property and reserved rights

As between you and HardCarrx, you retain rights in your content to the extent permitted by law and applicable third-party terms. HardCarrx and its licensors retain all rights, title, and interest in the service, software, documentation, branding, site content, product design, metrics, derivative improvements, and all related intellectual property. No rights are granted except as expressly stated.

9. Feedback

If you provide suggestions, ideas, or feedback, you grant HardCarrx a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free right to use, modify, commercialize, and incorporate that feedback without restriction or compensation.

10. Disclaimers

The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, HardCarrx disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free or fully accurate outputs.

11. Limitation of liability

To the maximum extent permitted by law, HardCarrx will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, data, or business opportunities. Any aggregate liability should be limited to the amounts paid by you to HardCarrx for the service during the 12 months before the claim giving rise to liability, subject to final legal review.

12. Indemnity

You agree to defend, indemnify, and hold harmless HardCarrx, its affiliates, and personnel from claims, liabilities, damages, judgments, losses, and costs arising out of your content, your use of the service, your violation of these terms, or your violation of applicable law or third-party rights.

13. Changes to the service or terms

We reserve the right to modify these terms and the service at any time. Updated terms become effective when posted or on the stated effective date. If you continue using HardCarrx after changes take effect, you agree to the revised terms.

14. Governing law and final legal terms

Governing law, dispute resolution, venue, contracting entity details, and any mandatory regional clauses should be finalized with legal counsel before broad public rollout.
